Construction Contracts Act - what is it, and how does it affect you?

If you are in the construction or building industry, one piece of legislation you need to know about is the Construction Contracts Act. This is for a variety of reasons, but one key reason is the payment claim/payment schedule process that the Act creates.

As a contractor you can turn your invoices into payment claims under the Act.  This requires your purchasers to respond to the claims, (as long as they are in a valid form) within 20 working days from receiving your claim.  If they don’t they lose the right in the first instance to dispute your claim, and you can immediately enforce it as a  judgment in the District Court.

From a purchasers perspective then the claim process is equally important.  You need to be aware of the possibility of making a payment claim so that if you receive one you can take advice on it quickly and respond with any disputes you have.

If you are either a contractor or a purchaser we are able to help with this process to make sure from the contractors prospective that your invoices are as enforceable as payment claims and from the purchasers perspective to make sure that you are able to respond so that if you have disputes you don’t lose the right to raise them.
